Renting Homes (Wales) Act 2016 — electrical safety

In Wales, the Renting Homes (Wales) Act 2016 requires a valid Electrical Condition Report at least every five years for rented homes, with copies to contract-holders.

Local context: Cardiff

Cardiff Council is the local housing authority. Every private landlord and letting agent in Wales must be registered and licensed through Rent Smart Wales, which Cardiff Council hosts on behalf of Welsh local authorities, and homes must be fit for human habitation under the Renting Homes (Wales) Act 2016.

South Wales Fire and Rescue Service is the fire and rescue authority.

Rows of Victorian terraces in areas such as Cathays and Splott sit alongside post-war council estates, and social landlords here work to the Welsh Housing Quality Standard 2023, which sets decarbonisation and quality targets beyond the older standard.

EICR in Cardiff: what is specific here

The Welsh rule is built into the fitness test. Under regulation 6, a landlord must hold a valid electrical condition report during every period of occupation. It stays valid for five years from the inspection, or for a shorter period if the report itself says the next inspection is due sooner. The tenant must receive a copy within 14 days of the occupation date, or within 14 days of any later inspection, and written confirmation of remedial work within 14 days of the landlord receiving it. The 14 day periods replaced 7 days from 30 November 2022. The inspection must follow BS 7671:2018+A2:2022 and cover installations serving the dwelling that sit in parts of the building the landlord owns or controls. Without a valid report the home is treated as unfit for human habitation until one is obtained.
